Architectural Review

Purpose and Intent
No building, fence, electric pet fence, sidewalk, drive, mailbox, or other structure, or improvement or anything attached thereto visible from the outside of the structure or improvement (including, without limitation, storm doors, windows, drapes or window coverings) shall be erected, placed, altered, or maintained within the Subdivision nor shall any exterior addition to or change (including any change in color) or alteration therein be made until the proposed building plans, specifications, exterior color and finish, plot plans (showing the proposed location of such improvement), and construction schedule shall have been submitted to and approved in writing by the Board of Directors of the Association, or by any architectural control committee appointed by said Board of Directors. Non-approval of plans, location or specification by said Board of Directors or architectural control committee may be based upon any reasonable ground, including, without limitation, lack of harmony of external design, color, location, or relation to surrounding structures and topography and purely aesthetic considerations which, in the sole discretion of said Board of Directors or architectural control committee, shall deem sufficient. If approval by the Board of Directors or architectural control committee is given, no alterations may be made in such plan except by and with prior written consent. (CC&R §9.1)

The ACC has the authority to recommend to the Board and Homeowner removal of any construction from any premise and/or the correction of any violation within the jurisdiction of the ACC.

In order to expedite your request, it is very important that we have all the required information regarding your project. The full breadth of the Covenants and Rules and Regulations dictate the review of this form, specifically, but not limited to Covenant Articles 1; 2; 4.3; 4.7.3; 7.8; 8.3.3; 9.1; 10; 10.13; and 11.

Please read and follow all instructions carefully:

  1. Please allow 30-45 calendar days from the date of submission for the approval
  2. A copy of the Property Survey/Plot Plan with the location of the changes/additions (clearly marked) must be included for each request or the request will be Returned requests will delay the overall processing time.
  3. Review all Covenants for the Lake View Homeowners Association of New Bern, Inc., and approved Rules and Regulations.
  4. Attachall required and requested details, documents, permits, information, or images.
  5. Complete one form per change (ex. One request for a garage and a separate request for a fence).
  6. The homeowner is responsible for obtaining any required (ex: Any building 12 or more feet in any direction must have a permit.)
  7. The Board and/or Architectural Control Committee reserves the right to request more information to clarify the application.

This request will expire 1 calendar year from date of approval. Once expired a new form is required to be submitted if project is not completed
